Terms of Service

Welcome to Lone Star Kayak Tours. These Terms of Service (“Terms”) govern your use of our website, your booking of
tours and rentals, and your communications with us. By accessing our website, booking a tour or rental, or opting in
to receive messages from us, you agree to these Terms. If you do not agree, please do not use our services.

Lone Star Kayak Tours is operated by Lone Star Kayak Tours LLC (“Company,” “we,” “us,” or “our”), located at 200 E
Riverside Dr, Austin, TX 78704.

1. Bookings and Reservations

All tours and rentals must be booked in advance through our website, by phone, or in person, subject to
availability. A reservation is confirmed only when you receive a confirmation from us. You are responsible for
providing accurate contact information at the time of booking. You must be at least 18 years of age to make a booking.
Minors must be accompanied by a responsible adult.

2. Payment

Full payment or a deposit may be required at the time of booking. All prices are listed in U.S. dollars and are
subject to change without notice. You agree to pay all charges associated with your booking, including any applicable
taxes and fees.

3. Cancellations, Refunds, and Weather

  • Cancellations made by the customer are subject to our cancellation policy provided at the time of booking.
  • We reserve the right to cancel or reschedule any tour due to weather, unsafe water conditions, insufficient
    bookings, or other circumstances beyond our control.
  • If we cancel a tour, you may reschedule or receive a refund of amounts paid for that tour.
  • No-shows and late arrivals that miss the scheduled departure are not eligible for a refund.

4. Assumption of Risk and Liability Waiver

Kayaking and related water activities involve inherent risks, including but not limited to capsizing, drowning,
collision, weather, water conditions, and physical exertion. By participating, you acknowledge and voluntarily assume
all such risks. All participants are required to sign a separate liability waiver and release of claims before
participating. You agree to follow all safety instructions given by our guides and staff, including the proper use of
personal flotation devices (PFDs), which must be worn at all times on the water.

To the fullest extent permitted by law, Lone Star Kayak Tours LLC, its owners, employees, guides, and agents shall
not be liable for any injury, death, loss, or damage to persons or property arising out of or in connection with your
participation, except where caused by our gross negligence or willful misconduct.

5. Health and Safety

You represent that you are in good physical health and able to participate safely. You agree to disclose any
medical conditions that may affect your ability to participate. We reserve the right to refuse participation to anyone
who appears to be under the influence of alcohol or drugs, or who poses a risk to themselves or others.

6. SMS / Text Message Terms

By providing your mobile phone number and opting in, you consent to receive recurring automated text messages from
Lone Star Kayak Tours, including booking confirmations, tour reminders, schedule and weather updates, and promotional
offers. Consent is not a condition of any purchase.

  • Message frequency varies based on your activity and our promotions.
  • Message and data rates may apply. Check with your mobile carrier for details.
  • To stop receiving messages at any time, reply STOP. You will receive a confirmation that you
    have been unsubscribed and will receive no further messages.

  • Carriers are not liable for delayed or undelivered messages.

We will not share or sell your mobile opt-in information or phone number with third parties or affiliates for their
marketing purposes. Mobile information will only be shared with service providers that help us deliver our messaging

7. Intellectual Property

All content on our website, including text, graphics, logos, photographs, and the Lone Star Kayak Tours name and
marks, is the property of Lone Star Kayak Tours LLC and is protected by applicable intellectual property laws. You may
not use, reproduce, or distribute our content without our prior written permission.

8. Photography and Media

We may photograph or record tours for promotional purposes. By participating, you grant us permission to use images
or recordings in which you may appear, without compensation, unless you notify a guide in writing that you do not
consent.

9. Conduct

You agree to behave responsibly, follow all instructions from our staff, respect the environment and other
participants, and comply with all applicable laws and regulations. We reserve the right to remove any participant
whose conduct endangers others or disrupts a tour, without refund.

10. Limitation of Liability

To the fullest extent permitted by law, in no event shall Lone Star Kayak Tours LLC be liable for any indirect,
incidental, special, consequential, or punitive damages arising out of or related to your use of our website or
services. Our total liability for any claim shall not exceed the amount you paid to us for the booking giving rise to
the claim.

11. Indemnification

You agree to indemnify and hold harmless Lone Star Kayak Tours LLC and its owners, employees, and agents from any
claims, damages, losses, or expenses, including reasonable attorneys’ fees, arising out of your participation in our
tours or rentals, your violation of these Terms, or your violation of any rights of a third party.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any
dispute arising under these Terms shall be resolved in the state or federal courts located in Travis County,
Texas.

13. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted to this page with a revised
effective date. Your continued use of our services after changes are posted constitutes acceptance of the updated
Terms.
